1. Introduction

Welcome to Rooted. These Terms of Use ("Terms") govern your access to and use of the Rooted mobile application ("App"), website at myrooted.app ("Website"), and related services (collectively, the "Service").

The Service is provided by MyRooted ("we," "us," or "our"), based in the United Kingdom.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and MyRooted.

3. Age Requirements

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have reviewed these Terms with your parent or legal guardian and that they have agreed to these Terms on your behalf.

If we learn that we have collected personal information from a user under 13, we will delete that information as quickly as possible.

4. Account Registration and Security

4.1 Anonymous Use

You may initially use the Service anonymously without creating an account. However, certain features (including Premium features) require you to create an account, either by using an email address and password or by signing in with Apple or Google.

If you choose Apple or Google sign-in, you authorise MyRooted to receive basic account information from that provider (such as your name and email address, where available).

4.2 Account Information

When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.3 Account Security

You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. User Content and Data

5.1 Your Data

You retain all rights to the data you input into the Service, including logs, notes, and photos ("User Content"). By using the Service, you grant us a limited licence to store, process, and display your User Content solely for the purpose of providing the Service to you.

5.2 Privacy

Your User Content is private and will not be shared with third parties except as described in our Privacy Policy.

5.3 Prohibited Content

You agree not to upload, post, or transmit any User Content that:

Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
Contains viruses, malware, or other harmful code
Violates any applicable laws or regulations

6. Premium Subscription

6.1 Premium Features

Rooted offers a Premium subscription ("Premium") that provides access to additional features including photo comparison, premium themes, pattern insights, and extended pattern views.

6.2 Free Trial

We may offer a free trial period for Premium. If you do not cancel before the trial ends, you will be charged the applicable subscription fee.

6.3 Billing

Premium subscriptions are billed monthly or annually through the Apple App Store or Google Play Store. Payment will be charged to your App Store or Play Store account at confirmation of purchase.

6.4 Auto-Renewal

Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription through your App Store or Play Store account settings.

6.5 Cancellation

If you cancel your Premium subscription, you will retain access to Premium features until the end of your current billing period. After that, your account will revert to the free tier and Premium features will no longer be accessible.

6.6 Refunds

Refunds are handled by the Apple App Store or Google Play Store according to their respective refund policies. We do not provide refunds directly.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service in any way that violates any applicable law or regulation
Attempt to gain unauthorised access to any portion of the Service or any other systems or networks
Interfere with or disrupt the Service or servers or networks connected to the Service
Use any robot, spider, or other automatic device to access the Service
Impersonate any person or entity or misrepresent your affiliation with any person or entity

8. Intellectual Property Rights

8.1 Our Rights

The Service, including all content, features, functionality, software, code, designs, graphics, and the selection and arrangement thereof, is owned by MyRooted and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use, subject to these Terms.

9. Termination

9.1 By You

You may terminate your account at any time by following the account deletion process in the App settings. Upon deletion, your User Content will be permanently deleted and cannot be recovered.

9.2 By Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

10. Disclaimers

10.1 No Medical Advice

THE SERVICE IS NOT INTENDED TO PROVIDE MEDICAL, HEALTH, OR PROFESSIONAL ADVICE. Rooted is a tracking and reflection tool only. Always seek the advice of qualified professionals for any hair, scalp, or health concerns.

10.2 As Is Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

To the fullest extent permitted by law, in no event shall MyRooted, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your use or inability to use the Service
Any unauthorised access to or use of your User Content
Any interruption or cessation of the Service
Any bugs, viruses, or other harmful code transmitted through the Service

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, and nothing in these Terms affects your statutory rights as a consumer.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (if you have provided one) or through a notice in the App. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of England and Wales.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MyRooted regarding the Service.

14.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force.

14.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
